In the following terms & conditions “the photographer” shall mean Fraizer Dunleavy trading as Fraizer Dunleavy Photography. “The clients” shall be those persons defined on quotations and/or invoices as the client. These terms & conditions cannot be varied in any way by the clients unless such conditions are expressly agreed by the photographer in writing. 


i. The copyright Designs and Patents Acts assign the copyright of the images to the photographer. It is contrary to the Act to copy or allow to be copied photographically, electronically or by any other means an image created by the photographer for the client(s) (as stated on quotation/invoice) without the written consent of the photographer in return for the relevant fee.

ii. Unless the photographer gives written authorisation, is forbidden by law for the client(s) to copy any images created by the photographer and agrees that all photographic reprints, digital duplications or copies of any type made from images created by the photographer shall only be carried out by the photographer. The licence to reproduce such images is granted to the client on the understanding that all invoices are paid within the photographer's stated payment terms.

iii. Reproduction rights (if and when granted) are strictly limited to the use specified on the photographer's invoice and/or quotation. An agreement must be reached with the photographer before the pictures are used for a different purpose or after the licence to use has expired. The photographer reserves the right to charge an additional fee if the photographs are used for purposes other than what is shown on the photographers invoice and/or quotation.

iv. All original negatives, transparencies and digital files created by the Photographer remain the property of the Photographer. The Photographer will ensure that all such materials are stored safely for the Client and make them available for future reproduction in return for the relevant fee.
v. The Photogra
pher reserves the right to make reproductions of images created during assignments for marketing, promotional, competition and editorial purposes.

vi. Franchise usage for single branch only, unless licence to use has been settled to cover multiple branches. Price available upon request.

vii. Any usage for commercial and/or corporate requirements will be subject to licence to use fees.


i. The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business (refer to point in advertising, brochures, magazine articles, websites, sample albums etc. 


i. Photographs taken during the course of the event and/or photography session will be at the discretion of the photographer although every effort will be made to comply with the clients requirements. 

ii. Special requests are not binding instruction, although every effort is made to comply with the client's wishes. The Photographer/s will do their best to honour the requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangements due to changes in weather, the availability and willingness of subjects.

iii. For a booking involving certain venues, the photographer's movements are sometimes restricted by event formalities and chosen layout. The area from which the photographer is able to cover the ceremony may not be the photographer's choice and the photographer cannot accept responsibility for any obstructed view should this be the case. 

iv. Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs. 

v. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure. 


i. A non-refundable booking fee will confirm your booking, as stated in the client(s) quotation and/or invoice as well as full acceptance of the terms and conditions as published on the photographer's website. The booking fee will be deducted from the overall quoted cost when calculating the final balance due. 

ii. Payment in full of the remaining balance will be due upon receipt of photographs.

iii. Additional goods ordered must be paid for in full at the time of ordering. 

iv. Titles to all goods remains with the photographer until paid for in full by the client(s) 


i. In the very unlikely events of cancellation by the photographer or of total photographic failure, liability shall be limited to a full refund of any fees paid. 

ii. The photographer will endeavour to put the client(s) in touch with another photographer in the event they are unable to attend a booking due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding, traffic conditions, vehicle breakdown etc. 


i. All digital negatives (computer files) remain the property of the photographer. All albums distributed include a copy of the edited digital negatives to the client(s) for their own non-commercial use.

ii. Should the digital negative files be lost, damaged of destroyed for the reasons beyond control, the photographers liability shall be limited to a full refund of any deposits and fees paid, but shall not include a refund for any goods already received.


i. The photographer will attend the locations specified by the client(s) at times specified upon booking. It is the client(s) responsibility to ensure locations and timings are correct factoring in travel time should multiple locations be required.

ii. Where an event lasts in excess of 7 hours a meal is required to be provided by the client(s).

iii. Any photography taken after the timings confirmed upon booking confirmation for the event/photography session will be at the discretion of the photographer or if expressly agreed in writing beforehand.


i. Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot. 


i. If the client(s) should have to cancel a booking the following cancellation fees will become due immediately upon said cancellation: 

ii. Cancellation from the booking date and more than two weeks to go until the event/photography session date, a cancellation fee of £100.00. 

iii. Cancellation with less than two weeks to go until the event/photography session date, full price for the complete booking. The client(s) are hereby advised to take out an appropriate insurance policy to cover any expenses incurred in the event of cancellation. 


i. The photographer will endeavour to deliver digital negative files as quickly as possible. However this could take up to 4-6 weeks during busy periods.
